Guernsey Court of Appeal dismisses claim for £391million

On 4 October 2016, the Guernsey Court of Appeal delivered judgment on appeals from a decision of the Royal Court, the upshot of which is that a claim seeking damages of £391million has been dismissed. It is understood to be the first occasion on which the Guernsey Courts have identified the principles to be applied in strike-out applications and claims for loss of a chance, which reflect those applied by the courts of England and Wales.  Read more by downloading the note here:  guernsey-court-of-appeal-dismisses-claim-for-391million

A guide to the Children’s Property and Tuteurs (Jersey) Law 2016

On 12 April 2016 the States of Jersey voted to update the Island’s customary law and statutory rules governing the administration of property belonging to children.

This reform is long overdue, the current Tutelle regime and procedure can be traced back to the early thirteenth century and have developed little over time, the last significant update occurring in 1862.

In 2002 the Jersey Law Commission proposed a complete overhaul of the law of tutelles and called for the 1862 statute to be repealed and replaced by new legislation. The new law entitled “Children’s Property and Tuteurs (Jersey) Law 2016” (the ‘Law’) came into force on 22 August 2016.

This decision of the Royal Court of Jersey is of interest being only the second case where the Court has heard an application under the Foundations (Jersey) Law 2009 (the “Foundations Law”).
