Topic: Lessons from the litigators – Pitfalls for Private Client Practitioners
Speakers: Naomi O’Higgins & Emily Mailer – Howard Kennedy LLP
Naomi and Emily will focus on three key areas of practice for private client practitioners, namely (a) capacity (b) Wills and (c) trusts and the potentially contentious complications which can crop up in relation to them. They will provide guidance on these issues, from their perspective as London based private client litigators, with some practical tips on how best to avoid or mitigate them.
Naomi O’Higgins and Emily Mailer are Partners at Howard Kennedy.
Naomi advises families, individuals, trustees and beneficiaries involved in disputes, particularly in relation to trusts and estates.
She has particular experience of litigation with international and cross-border elements and has worked with lawyers in a number of foreign/offshore jurisdictions including Jersey, Guernsey, the Cayman Islands, the Bahamas and Switzerland. She also advises on Court of Protection work such as statutory wills, disputes regarding the appointments or actions of attorneys and other matters concerning people lacking capacity to manage their own affairs.
Naomi is ranked in Legal 500 as a leading individual and is described as “very measured, extraordinarily knowledgeable and gives practical and realistic advice”.
Emily is ranked in Chambers HNW and Legal 500 as a leading individual in private wealth disputes. She is recognised as someone “who understands the nuances which arise in what is often family-based litigation” and has been described as “everything you want in a fellow professional litigator”.
Emily is a member of the Association of Contentious Trusts and Probate Specialists (ACTAPS) and the Law Society Probate Section.
